Ready Hero Fit – Terms of Service

Welcome to Ready Hero Fit. These Terms of Service (“Terms”) form a legally binding agreement between you and Ready Hero Fit LLC (“Ready Hero Fit,” “we,” “us,” or “our”) and govern your access to and use of our virtual reality fitness game and related services (collectively, the “Game”).

By downloading, installing, accessing, or using the Game, you agree to be bound by these Terms. If you do not agree, do not use the Game.

1. Eligibility

You must be at least 16 years old to use the Game. If you are under 18, your parent or legal guardian must accept these Terms on your behalf and supervise your use of the Game.

We do not knowingly collect personal information from children under the age of 16.

Your use of the Game may also be subject to the terms of the platform or store (e.g., Meta Quest, Steam) from which you downloaded it. If there is a conflict between these Terms and any platform terms, the platform’s terms will govern for your use on that platform.

By using the Game, you represent and warrant that you meet the eligibility requirements and that your use of the Game complies with all applicable local, state, and federal laws.

2. License and Ownership

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Game for your personal, non-commercial purposes.

You acknowledge that:

●      The Game is licensed, not sold.

●      All rights, title, and interest in the Game, including all intellectual property rights (e.g., copyrights, trademarks, patents, trade secrets), remain the property of Ready Hero Fit or its licensors.

●      You may not copy, modify, reverse engineer, decompile, distribute, or create derivative works from the Game except as permitted by law.

3. Permitted Use

You may:

●      Use the Game for your own personal enjoyment.

●      Share non-commercial gameplay content (e.g., screenshots or video clips) on personal social media accounts.

●      Use updates or additional content we may make available.

You may not:

●      Sell, sublicense, rent, or transfer the Game.

●      Exploit the Game for commercial purposes.

●      Use the Game in any way that violates laws, third-party rights, or these Terms.

4. Updates and Availability

We may update the Game from time to time. Updates may be required for continued access. We may modify or discontinue the Game at any time, with or without notice.

5. Health, Safety, and Use of VR

Using VR equipment carries risks. You agree to:

●      Review and follow all safety warnings provided by your VR hardware provider (Meta Health & Safety).

●      Use the Game only when you are in good health and in a safe, clear environment.

●      Stop use immediately if you experience dizziness, nausea, discomfort, or any unusual physical or mental symptoms.

By using the Game, you affirm that either (a) your physician has approved your use of VR-based fitness, or (b) all of the following are true:

●      You have never been told you have a heart condition;

●      You have never experienced chest pain or loss of consciousness during activity;

●      You are not pregnant;

●      You do not have any other health conditions that would put you at risk when engaging in physical activity.

You acknowledge that participation in physical activity carries inherent risks, and you voluntarily assume all such risks. Ready Hero Fit is not responsible for any injuries, health issues, or accidents that may occur during use.

If you have a condition that affects balance, vision, motion sensitivity, or neurological function, consult a healthcare provider before using VR-based fitness.

6. User Conduct

You agree not to:

●      Harass, harm, or impersonate other users.

●      Post content that is illegal, offensive, or infringes others' rights.

●      Use cheats, exploits, bots, or unauthorized software.

●      Interfere with other players’ experiences.

We may monitor and moderate conduct, and we may suspend or terminate access for violations.

7. User Content

You acknowledge and agree that your submission of content does not make you an employee, contractor, or partner of Ready Hero Fit, and you shall not be entitled to any compensation, royalties, or reimbursement except as otherwise agreed in writing.

You retain ownership of content you submit through the Game. By submitting content, you grant us a worldwide, irrevocable, perpetual, royalty-free, sublicensable license to use, reproduce, modify, publish, display, and distribute your content in connection with the Game.

To the extent permitted by applicable law, you waive any moral rights or rights of attribution in your submitted content

If you believe content in the Game infringes your copyright, you may notify us at hello@readyherofit.com with a formal takedown request including identification of the infringing content and your contact information.

8. DMCA Notice

If you believe your copyrighted work has been used in a way that constitutes infringement, please submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your notice must comply with 17 U.S.C. § 512(c)(3).

9. Privacy & Data Collection

We collect data to operate and improve the Game, including technical logs, crash reports, and usage analytics. Personal data will be handled in accordance with our Privacy Policy.

Diagnostic data may include device type, system performance, gameplay activity, and VR equipment used. Some feedback or logs may contain personal information (e.g., account name), and you agree that we may use this information to improve our services. You may opt out of certain data processing for gameplay analytics, including personalization features, by adjusting the applicable settings within the Game itself. This opt-out is managed exclusively through the in-game settings menu and is not controlled by or dependent upon any platform-level privacy settings.

The Game may include or link to third-party services or content (including VR platform tools, fitness trackers, or social media integrations). Ready Hero Fit is not responsible for the availability, accuracy, or security of third-party services, and use of those services is subject to their own terms and privacy policies.

We do not sell or share your personal data for cross-context behavioral advertising as defined under U.S. state privacy laws. You can learn more or exercise your data rights in our Privacy Policy.

10. Disclaimers

The Game is provided "as is" and "as available."
To the maximum extent permitted by law:

●      We do not guarantee the Game will be uninterrupted or error-free.

●      We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

●      Use of the Game is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

●      Indirect or consequential damages;

●      Loss of data or business;

●      Physical injury, property damage, or system failure;

●      Any issues arising from unauthorized use or third-party services.

In no event will our liability exceed the amount you paid for the Game or, if greater, the amount you paid in the twelve (12) months preceding the event giving rise to the claim, subject to applicable refund policies of the platform through which you purchased the Game.

We recommend backing up your data and ensuring you meet system requirements before using the Game.

12. Termination

You may stop using the Game at any time.

We may suspend or terminate your access to the Game if you violate these Terms. Upon termination, you must delete the Game from your devices.

All purchases (including in-app content) are final and non-refundable except as required by applicable law or platform policy. We do not offer refunds or credits for partial use, inactivity, or dissatisfaction.

Refunds (if any) will be subject to the applicable store’s policies. Where feasible, and if you have not had a reasonable opportunity to enjoy paid content, we may offer a refund or credit at our discretion.

13. In-App Purchases

The Game is free to download and includes access to the initial level. Additional content, such as subsequent worlds or levels, may be unlocked through one-time in-app purchases ("IAPs"). Preorders for upcoming content (e.g., the rest of the first world) may also be available as IAPs.

All IAPs are processed through the platform (e.g., Meta Quest, Steam) where you purchased it and are subject to that platform's terms, including payment methods, taxes, and fees.

IAPs are non-transferable and non-refundable, except as required by applicable law or the platform's refund policy. We do not offer refunds for IAPs due to regret, partial use, or changes in content availability, but we may provide refunds or credits at our discretion if you have not accessed the purchased content or if delivery is significantly delayed.

Preordered content will be delivered as soon as it becomes available, but release dates are estimates and subject to change. If a preorder cannot be fulfilled, we will notify you and process a refund in accordance with platform policies.

You can view and manage your purchases through the platform (e.g., Meta Quest, Steam) where you purchased it. To prevent unauthorized IAPs (e.g., by minors), use platform-provided parental controls or account security features.

14. Export Controls

You may not export or re-export the Game except as authorized by U.S. law and the laws of the jurisdiction in which the Game was obtained.

15. Dispute Resolution; Mediation; Arbitration; Class Action Waiver

15.1 Friendly Resolution First

In the event of any controversy or claim arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute through friendly consultation, which shall last no less than 30 days from the date one party notifies the other of the dispute in writing.

15.2 Mediation (Nonbinding)

If the parties are unable to resolve the dispute through consultation, either party may request that the matter be submitted to nonbinding mediation administered by JAMS (or a mutually agreed provider), to take place remotely or in a mutually convenient location. Each party shall bear its own costs of mediation.

15.3 Binding Arbitration

If the dispute is not resolved by mediation within 60 days of its initiation, it shall be finally resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, or the applicable rules agreed to in writing. The arbitration shall be conducted remotely or in a location reasonably convenient to both parties.

15.4 No Class or Representative Actions

You and Ready Hero Fit agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to bring or participate in a class or representative action.

15.5 Right to Opt Out

You may opt out of arbitration by sending written notice to hello@readyherofit.com within 30 calendar days of first accepting these Terms or first using the Game, whichever is earlier. Opting out does not waive the class action waiver provision.

15.6 Equitable Relief

Nothing in this Section shall prevent either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction, where necessary to protect its rights pending final resolution through arbitration.

15.7 Confidentiality

All proceedings under this Section, including but not limited to consultation, mediation, and arbitration, shall be confidential.

16. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles. Legal actions not subject to arbitration must be brought in King County, Washington. This provision does not override any mandatory consumer protection laws in your state of residence.

17. General Terms

●      If any provision is found unenforceable, the rest remain effective.

●      We may update these Terms; continued use means you accept any changes.

●      You may not transfer your rights under these Terms.

●      Delays in enforcement do not waive our rights.

18. Force Majeure

We are not liable for any delay or failure in performance due to events outside our reasonable control, including acts of God, natural disasters, internet outages, labor disputes, government actions, or pandemics. Obligations are suspended for the duration of such events.
